Tokemy’s Swap service enables fast, automated crypto exchanges through a secure execution-only infrastructure. Transactions are settled instantly at pre-agreed rates, with transparent and automated fee allocation. The service operates strictly on a non-custodial and non-advisory basis, in alignment with Regulation (EU) 2023/1114 (MiCA) and the UK cryptoasset AML framework under the Money Laundering Regulations 2017 (as amended).

We include in all Swap Transaction Forensic Certification powered by Elliptic, (Enhanced Compliance Service), Upon the Client’s written request and at the Client’s sole expense, Tokemy may facilitate access to an independent third-party blockchain forensic certification in relation to digital assets involved in a swap transaction. The service may include transaction tracing, provenance analysis, sanctions screening, and AML/CFT risk assessment. Tokemy does not perform the forensic analysis internally, does not receive any fees related to this service, and acts solely as a technical facilitator.This service is enhanced due diligence support is structured in alignment with Regulation (EU) 2023/1114 (MiCA) and the UK Money Laundering, Terrorist Financing and Transfer of Funds Regulations 2017 (as amended).The forensic provider acts independently, and any report issued does not constitute regulatory approval, legal validation, or financial endorsement by Tokemy.

Tokemy does not perform the forensic analysis internally, does not receive fees from this service, and acts solely as a technical facilitator.

8. How are commissions and fees handled?
Fees and commissions are programmatically calculated and distributed to pre-designated wallets according to the parameters recorded for each transaction, without discretionary intervention.

When the USDT loading gets larger 10k / 100k / 1m / 10m, my principal may have some fear that the amount gets taken away & swiped by the platform operator, how would I alleviate his concern?
The platform operator has no access whatsoever to client wallets. Tokemy operates strictly with public wallet addresses and never has access to private keys. As a result, it is technically impossible for the platform to interfere with, control, or withdraw any funds from client wallets. Moreover, the underlying blockchain swap infrastructure is specifically designed to guarantee secure, point-to-point transactions. All movements of crypto assets occur directly on-chain, in full compliance with the rules and protocols enforced within the BNB network. This architecture ensures that assets remain under the sole control of the user at all times, eliminating counterparty risk related to custody or unauthorized access. 

And lastly how can we know for sure the BTC is not tainted or previously bought with illegal or criminal funds, i.e. it’s tainted ?
Tokemy guarantees that, at the moment a swap service is requested, an initial analysis screen is immediately displayed to verify that the BTC involved is not tainted.

At the end of the swap transaction, a downloadable certificate is issued directly from the platform, confirming the outcome of the compliance and forensic checks.

IS MANDATORY TO DO KYC  ON TOKEMY,CH?
Yes. KYC is mandatory on TOKEMY.CH: to open and use an account, perform transactions, and maintain access to the services, users must complete the required identity verification procedures. Failure to complete KYC may result in account limitations, suspension, or termination.

Policy Money laundering is defined as the process by which the identity of proceeds of crime is concealed so that it appears as legitimate income. Criminals specifically target financial services firms to launder illicit funds without the firm’s knowledge or suspicion. In response to the scale and impact of money laundering, the European Union has enacted Directives designed to combat money laundering and terrorist financing. These Directives, together with applicable regulations, rules, and industry guidance, form the cornerstone of AML/CFT obligations and define the offenses and penalties for non-compliance. Whilst TOKEMY.CH is currently unregulated and may not fall within the full scope of AML/CFT regulatory obligations, senior management has implemented systems and procedures aligned with European Union standards. This reflects a clear commitment to preventing financial crime and ensuring that the platform is not used for illicit purposes. Anti-Money Laundering (AML) Policy The AML Policy of TOKEMY.CH is designed to prevent money laundering and terrorist financing by aligning with European standards. It ensures the implementation of adequate systems and controls to mitigate the risk of the platform being used for financial crime. This AML Policy establishes the following minimum standards: Appointment of a Money Laundering Reporting Officer (MLRO) with sufficient seniority and independence, responsible for overseeing compliance with applicable laws, regulations, and guidance; Adoption of a Risk-Based Approach (RBA) for assessing and managing money laundering and terrorist financing risks; Implementation of Customer Due Diligence (CDD), identification, verification, and Know Your Customer (KYC) procedures, including enhanced due diligence for higher-risk clients such as Politically Exposed Persons (PEPs); Ongoing monitoring of customer activity through risk-based systems and procedures; 
  • Establishment of internal procedures for reporting suspicious activity to relevant authorities;
  • Maintenance of appropriate records for the legally prescribed retention periods;
  • Provision of continuous staff training and awareness programs.
 Mandatory Source Validation Protocol In accordance with global AML/CFT standards, TOKEMY.CH may require users to execute a certified transfer of funds originating exclusively from the primary funding source(s) used to initially fund their account. These sources may include cryptocurrency wallets, exchanges, or other financial intermediaries. The required amount will be determined based on a comprehensive evaluation of transactional behavior, cumulative activity, and risk profiling analytics. Failure to comply with this requirement may result in account restrictions, including but not limited to: 
  • Limitations on withdrawals
  • Restrictions on trading activity
  • Suspension of operational functionalities
  • Sanctions Policy
